The U.S. Supreme Court shall rule that the Fifth Circuit's re-endorsement of the University of Texas at Austin's use of racial preferences in undergraduate admissions decisions can not be sustained under the Supreme Court's decisions interpreting the Equal Protection Clause of the Fourteenth Amendment.

The decision need not be applicable to or have an impact on the admissions policies of other universities. Should the Court remand the case to the Fifth Circuit, this market will resolve as No, irrespective of any new or clarifying guidance provided by the Court. Should the Court be evenly divided on this matter, this market will resolve as No.
